These Website Terms and Conditions (“Terms”) govern your access to and use of the EmCare Training LLC website, online registration system, course listings, customer portal, educational resources, communications, and related services.

In these Terms, “EmCare Training,” “EmCare,” “we,” “us,” and “our” refer to EmCare Training LLC. “You” and “your” refer to the website visitor, student, purchaser, organization, or other person using our website or services.

By accessing our website, creating an account, submitting a registration, purchasing a course or service, or using our online resources, you acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree to these Terms, you should not use the website or complete a purchase.

If a course-specific written policy conflicts with these general Terms, the course-specific policy will control for that particular course or transaction.

2. Eligibility to Use the Website

You must be legally capable of entering into an agreement to make a purchase through our website.

Individuals younger than 18 years of age may require registration, authorization, or payment from a parent or legal guardian.

By registering a minor, the parent, legal guardian, or authorized adult confirms that they:


  • Have authority to register the student;
  • Agree to these Terms on the student’s behalf;
  • Accept financial responsibility for the registration; and
  • Will ensure that the student follows all applicable course requirements.


An organization registering students represents that the person completing the registration has authority to act on behalf of that organization.

3. Website Information

EmCare Training makes reasonable efforts to provide accurate and current information regarding:


  • Course descriptions;
  • Course dates and times;
  • Training locations;
  • Instructor information;
  • Certification requirements;
  • Prices;
  • Registration availability; and
  • Course prerequisites.

However, website information may occasionally contain typographical errors, outdated information, technical errors, or omissions.

EmCare reserves the right to correct errors and update information at any time.

A listed course, price, date, or service does not guarantee availability. Registration is subject to capacity, instructor availability, facility availability, payment, and confirmation by EmCare Training.

4. Website Availability

EmCare Training does not guarantee that the website or online registration system will be available without interruption.

Access may be limited or temporarily unavailable because of:


  • Scheduled maintenance;
  • Software updates;
  • Server or internet failures;
  • Payment-processing problems;
  • Cybersecurity concerns;
  • Equipment failures;
  • Events beyond our reasonable control; or
  • Other technical or operational issues.

EmCare may modify, suspend, restrict, or discontinue any part of the website or its features at any time.

When a technical issue affects a registration or payment, customers should contact EmCare Training before submitting the transaction again.

5. Registration Information

You agree to provide complete, current, and accurate information when registering for a course or purchasing a service.

Registration information may include:


  • The student’s legal name;
  • Contact information;
  • Email address;
  • Telephone number;
  • Billing information;
  • Course selection;
  • Employer or organization information;
  • Certification information;
  • Accommodation requests; and
  • Other information necessary to administer the course.

You are responsible for reviewing your information before submitting a registration.

EmCare is not responsible for delays, missed communications, incorrect certifications, or registration problems caused by inaccurate or incomplete information supplied by the student or purchaser.

You must notify EmCare promptly if your registration information changes.

6. Accounts and Account Security

Certain website functions may require you to create an account or use a customer portal.

You are responsible for:

  • Maintaining the confidentiality of your username and password;
  • Limiting access to your account;
  • Using accurate account information;
  • Protecting course access codes and digital materials; and
  • Notifying EmCare of suspected unauthorized activity.

You may not share an account, online-course login, access code, certification account, or customer portal with another person unless EmCare or the applicable course provider expressly permits it.

EmCare may suspend or terminate an account when it reasonably believes that the account is being misused, shared without authorization, used fraudulently, or used in violation of these Terms.

7. Course Registration

Submitting a registration does not guarantee enrollment until the registration has been accepted and any required payment has been received.

Students are responsible for reviewing the following before registering:

  • The correct course title;
  • Course date and time;
  • Training location;
  • Course format;
  • Required prerequisites;
  • Physical participation requirements;
  • Certification-provider requirements;
  • Payment terms;
  • Cancellation and refund rules; and
  • Any required online or pre-course assignments.

Course-specific attendance, attire, physical-performance, conduct, testing, accommodation, and completion requirements are described in the EmCare Training Class Terms and Conditions.

8. Prices and Payment

Course and service prices are displayed in United States dollars unless otherwise stated.

Payment may be required:

  • At the time of registration;
  • Before the course begins;
  • According to an approved invoice;
  • According to a group-booking agreement; or
  • According to another written arrangement approved by EmCare Training.
  • You authorize EmCare and its payment processors to charge the payment method provided for the amount shown during checkout or stated on the applicable invoice.
  • You represent that you are authorized to use the submitted payment method.
  • EmCare may refuse or cancel a registration when:
  • Payment is declined;
  • Payment cannot be verified;
  • The transaction appears fraudulent;
  • The listed price was clearly incorrect;
  • Required information was not provided; or
  • The purchaser violates these Terms.

Customers are responsible for any taxes, processing charges, or additional fees clearly disclosed before purchase.

9. Pricing Errors

EmCare Training reserves the right to correct an incorrect price caused by a typographical, technical, or administrative error.

When an incorrect price affects a completed transaction, EmCare may:

  • Honor the incorrect price;
  • Contact the purchaser for authorization to charge the correct price; or
  • Cancel the transaction and issue a refund.

EmCare will not charge a higher corrected price without notifying the purchaser.

10. Group and Organizational Bookings

Additional terms may apply to registrations made by an employer, agency, school, organization, or group.

The person making a group reservation is responsible for:

  • Providing accurate student information;
  • Communicating course requirements to participants;
  • Confirming the number of students;
  • Meeting payment deadlines;
  • Communicating cancellation and refund rules;
  • Coordinating access to the training location, when applicable; and
  • Ensuring that participants comply with EmCare policies.

Group booking requirements, deposits, final payments, cancellations, and refunds are governed by the applicable proposal, invoice, Class Terms and Conditions, and Refund Policy.

11. Refunds, Cancellations, and Rescheduling

All cancellations, refunds, transfers, missed courses, late arrivals, and rescheduling requests are governed by the EmCare Training Refund Policy and Class Terms and Conditions.

Customers are responsible for reviewing those policies before completing a purchase.

Unless otherwise stated in writing:

  • Cancellation requests must be submitted by email;
  • Refund eligibility is based on when EmCare receives the written request;
  • Accessed digital content may be nonrefundable;
  • Scheduled skills sessions may be nonrefundable;
  • Late arrivals and no-shows are not eligible for refunds; and
  • Failure to pass a course does not create an entitlement to a refund.

Submitting a cancellation request does not confirm approval. Customers should retain the written cancellation or refund confirmation provided by EmCare Training.

12. Blended-Learning and Online Courses

Blended-learning courses may include an online educational component followed by an instructor-led skills session.

Online courses, access codes, and digital materials are issued only to the registered student and may not be:

  • Shared;
  • Resold;
  • Copied;
  • Transferred;
  • Posted publicly;
  • Used by another student; or
  • Distributed without authorization.
  • Students are responsible for confirming that their computer, mobile device, browser, internet connection, and email account can access the online materials.

Students must complete the online portion and provide acceptable proof of completion within the required timeframe.

Online access and skills-session refund rules are explained in the EmCare Training Refund Policy.

13. Course Completion and Certification

Purchasing or attending a course does not guarantee:

  • Successful course completion;
  • Passing examination results;
  • Certification;
  • Licensure;
  • Employment;
  • Promotion;
  • Acceptance by an employer;
  • Acceptance by a licensing agency; or
  • Acceptance by another training organization.

Students must satisfy all applicable attendance, participation, examination, skills, and performance requirements.

Certification eligibility and completion standards may be established by an outside certification organization. EmCare cannot waive requirements controlled by another organization.

Students are responsible for confirming that a course or certification meets the requirements of their employer, school, licensing agency, or other organization before registering.

14. Certifications and Course Records

Students are responsible for providing accurate names and contact information for certificates, completion cards, and course records.

EmCare may provide course-completion information to:

  • The student;
  • The organization that paid for or arranged the course;
  • The applicable certification provider;
  • A licensing or regulatory authority;
  • An employer when authorized or legally permitted; or
  • Another party when required by law.

Replacement cards, corrected certificates, archived-record searches, or duplicate documents may be subject to additional fees.

The availability and retention of course records may depend on the policies of the applicable certification organization.

15. Reasonable Accommodations

EmCare Training is committed to providing reasonable access to its programs.

Accommodation requests should be submitted as early as possible before the scheduled course.

EmCare will evaluate requests individually and may ask for information reasonably necessary to understand and arrange the requested accommodation.

An accommodation cannot:

  • Eliminate an essential course requirement;
  • Waive a required hands-on skill;
  • Compromise health or safety;
  • Fundamentally alter the course;
  • Override the requirements of a certification provider; or
  • Guarantee course completion or certification.

16. Acceptable Website Use

You agree to use the website only for lawful purposes.

You may not:

  • Attempt to gain unauthorized access to the website or another person’s account;
  • Interfere with the operation or security of the website;
  • Introduce viruses, malicious code, or harmful technology;
  • Use automated tools to copy or collect website content without authorization;
  • Submit false, misleading, or fraudulent information;
  • Impersonate another person or organization;
  • Use stolen or unauthorized payment information;
  • Attempt to register another person without authorization;
  • Circumvent website security or access controls;

  • Harass EmCare personnel, instructors, students, or website users; or
  • Use the website in a manner that violates applicable law.

EmCare may restrict or terminate access when a user violates these Terms or creates a security, legal, safety, or operational concern.

17. Intellectual Property

The EmCare Training website and its original content are owned by or licensed to EmCare Training LLC.

Protected content may include:

  • Business names;
  • Logos;
  • Graphics;
  • Photographs;
  • Videos;
  • Course descriptions;
  • Written materials;
  • Forms;
  • Presentations;
  • Downloads;
  • Website layouts;
  • Software;
  • Training resources; and
  • Other original content.
  • Website access does not transfer ownership or intellectual-property rights to the user.
  • You may view and use website content for personal, noncommercial purposes related to evaluating or participating in EmCare services.
  • Without prior written permission, you may not:
  • Reproduce website content;
  • Republish website content;
  • Sell or license website materials;
  • Modify or create derivative materials;
  • Remove copyright or ownership notices;
  • Use EmCare branding to suggest an unauthorized relationship; or
  • Use course materials to conduct your own training.

Materials belonging to the American Heart Association, American Red Cross, National Safety Council, or another third party remain the property of their respective owners and are subject to their applicable licensing requirements.

18. User-Submitted Content

When you submit a review, testimonial, photograph, comment, suggestion, or other content to EmCare, you represent that:

The submission is accurate;

  • You have authority to provide it;
  • It does not violate another person’s rights;
  • It does not contain unlawful or harmful material; and
  • Its use by EmCare will not violate an agreement with another party.

EmCare will not publicly use a student’s photograph, testimonial, or personally identifying story for promotional purposes without appropriate authorization.

You may not submit confidential medical information or sensitive personal information through a general website form unless the form specifically requests that information.

19. Third-Party Websites and Services

The EmCare website may contain links to third-party websites, course platforms, payment processors, certification providers, mapping services, social-media platforms, or other external services.

These links are provided for convenience and do not mean that EmCare controls or endorses every statement, product, or practice of the third party.

  • Third-party websites operate under their own:
  • Terms and conditions;
  • Privacy policies;
  • Refund policies;
  • Security practices; and
  • Accessibility standards.

EmCare is not responsible for the content, availability, privacy practices, security, or performance of third-party websites and services.

20. Email and Electronic Communications

Registrations;

  • Payments;
  • Course confirmations;
  • Schedule changes;
  • Reminders;
  • Online-course access;
  • Certification records;
  • Refunds;
  • Customer-service requests; and

You are responsible for maintaining an accurate email address and checking spam or junk-mail folders.

Transactional messages may be sent even when a customer has opted out of promotional marketing communications.

Marketing communications may include instructions for unsubscribing.

EmCare’s collection, use, retention, and disclosure of personal information are governed by the EmCare Training Privacy Policy.

Training content may describe general emergency-response practices. In an actual emergency, individuals should activate the appropriate emergency-response system and follow current directions from qualified emergency personnel.

23. No Guarantee of Results

EmCare Training does not guarantee that use of the website, attendance at a course, or receipt of certification will produce a particular personal, professional, academic, financial, licensing, or employment result.

Results depend on factors including:

  • Student participation;
  • Knowledge and skill performance;
  • Examination results;
  • Certification-provider standards;
  • Employer requirements;
  • Licensing requirements; and
  • Circumstances outside EmCare’s control.


24. Disclaimer of Warranties

To the fullest extent permitted by law, the website and its content are provided on an “as available” and “as is” basis.

EmCare does not guarantee that:

  • The website will always be available;
  • Website content will be free from every error;
  • The website will be free from viruses or other harmful components;
  • Every course will remain available;
  • Every external link will remain active; or

Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.


25. Limitation of Liability

EmCare may suspend or terminate a user’s access to the website, customer portal, registration system, or digital materials when the user:

  • Engages in fraudulent activity;
  • Creates a security risk;
  • Misuses course materials;
  • Harasses staff or students;
  • Fails to make required payment; or

  • Termination does not eliminate payment obligations or other responsibilities that arose before termination.


Provisions concerning intellectual property, payment obligations, disclaimers, liability, dispute resolution, and other terms that logically survive termination will remain in effect.


28. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.


Any legal proceeding relating to these Terms, the website, or services provided by EmCare Training must be brought in a court with proper jurisdiction in New Jersey, unless applicable law requires otherwise.


Before filing a legal proceeding, the parties are encouraged to contact one another and make a good-faith effort to resolve the dispute informally.


Nothing in this section prevents a customer from exercising a right or remedy that cannot legally be waived.


29. Changes to These Terms

EmCare may update these Terms periodically to reflect changes in:

Services;

  • Business practices;
  • Certification requirements;
  • Technology;
  • Payment processes; or
  • Applicable legal requirements.

The updated version will be posted on the website with a revised “Last Updated” date.

The version presented or linked at the time of a purchase will generally govern that transaction.


Continued use of the website after revised Terms become effective constitutes acceptance of the revised Terms for future website use.


30. Severability

These Terms, together with the Privacy Policy, Refund Policy, Class Terms and Conditions, Disclaimer, and any applicable written course or group agreement, constitute the agreement between you and EmCare concerning your use of the website and related services.

They replace prior website-related representations or agreements concerning the same subject matter.
